These Terms of Service (the "Terms") form a legally binding agreement between you ("you", "your", or "User") and the EasyPeek team ("EasyPeek", "we", "us", or "our") governing your access to and use of the EasyPeek mobile application and any related services, features, or content we make available (collectively, the "Service").
Please read these Terms carefully. By downloading, installing, opening, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install, or use the Service.
1. Acceptance of the Terms
By accessing or using the Service in any manner, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers both to you individually and to that organization.
2. Description of the Service
EasyPeek is a mobile application that lets users add customizable watermarks — including timestamps, dates, location information, and custom text — to photos and videos captured by, or already stored on, the user's device. Additional features may include photo editing tools, batch processing, history tracking, and export and sharing options.
All watermark rendering and media processing takes place locally on your device. We may add, modify, or discontinue features at any time in our sole discretion.
3. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction to consent to the use of a mobile application without parental permission) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian.
4. License to Use EasyPeek
Subject to your compliance with these Terms, EasyPeek grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on Apple devices that you own or control, for your personal or internal business purposes.
You agree that you will not, and will not permit others to:
- Copy, modify, translate, or create derivative works of the Service;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying ideas of the Service, except to the extent expressly permitted by applicable law;
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, or otherwise transfer the Service or any rights therein;
- Remove or obscure any proprietary or legal notices displayed in or on the Service;
- Use any automated system to access the Service in a way that sends more request messages to our servers or partners' servers than a human could reasonably produce in the same period.
5. Your Content
The Service allows you to import, process, and export your own photos, videos, text, and other media ("User Content"). You retain all rights, title, and interest in and to your User Content. EasyPeek does not claim any ownership of your User Content.
Because the Service processes User Content locally on your device and does not upload it to our servers, EasyPeek does not receive a license to your User Content and cannot access it.
You are solely responsible for your User Content and for ensuring that you have all rights, licenses, consents, and permissions necessary to capture, use, and modify it, including any rights related to persons depicted in your photos or videos.
6. Acceptable Use
You agree that you will not use the Service to:
- Violate any applicable law, regulation, or third-party right, including intellectual property, privacy, publicity, or contract rights;
- Create, capture, edit, or share content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable;
- Falsify or misrepresent the time, location, or origin of any content in a manner intended to deceive others, defraud, or cause harm;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Interfere with, disrupt, or damage the Service, our servers or partners' servers, or any user's use of the Service.
Watermarks generated by the Service (including timestamps and locations) are intended as informational overlays reflecting device settings and sensor data at the time of capture or editing. They are not forensic timestamps, and should not be relied upon as legal proof of when or where a photograph or video was taken.
7. Intellectual Property
The Service, including its software, design, user interface, graphics, text, trademarks, service marks, logos, and other content (excluding User Content), is and will remain the exclusive property of EasyPeek and its licensors, and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 4, no rights are granted to you under these Terms.
8. Third-Party Services
The Service is distributed through the Apple App Store and interacts with operating-system services and hardware features provided by Apple (including camera, photo library, and location services). Your use of these underlying services is governed by Apple's terms and privacy policy in addition to these Terms.
Apple is not a party to these Terms and has no obligation to provide any support or maintenance for the Service. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
9. In-App Purchases & Fees
The Service may currently be free of charge, or may include paid features, subscriptions, or in-app purchases. Where paid features are offered, prices and billing terms will be presented in the App Store at the point of purchase and are processed by Apple according to Apple's payment terms. Subscriptions renew automatically unless canceled through your Apple ID account settings before the end of the current billing period.
Except where required by applicable law, all purchases are non-refundable and are subject to the App Store's refund policies.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYPEEK, ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that watermark timestamps, dates, or location information will be accurate, complete, or suitable for any particular purpose.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EASYPEEK OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
IN NO EVENT WILL EASYPEEK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO EASYPEEK FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS (US$50).
12. Indemnification
You agree to defend, indemnify, and hold harmless EasyPeek and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property, publicity, or privacy right.
13. Termination
These Terms remain in effect while you use the Service. You may stop using the Service and delete the app from your device at any time. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms or if we discontinue the Service.
Upon termination, all rights and licenses granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will survive.
14. Changes to the Service
We are continually improving the Service. We may add, remove, or modify features at any time, release new versions, or discontinue the Service entirely, in each case without liability to you.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, where changes are material, provide reasonable notice through the Service or by other means. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms.
16. Governing Law & Disputes
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws applicable to the place of EasyPeek's principal place of business, excluding its conflict-of-laws principles. To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively in the competent courts of that jurisdiction.
Nothing in this section limits any mandatory consumer-protection rights that apply to you under the laws of the country in which you reside.
17. Miscellaneous
These Terms, together with the Privacy Policy and any other legal notices published by EasyPeek in the Service, constitute the entire agreement between you and EasyPeek concerning the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. You may not assign or transfer these Terms without our prior written consent, and any attempted assignment in violation of this section will be void.
